Terms and Conditions

Please read this carefully. By accessing the SmartEconomist.com website (“the Service”) you (“the Subscriber”) are agreeing to the terms and conditions below. These are the terms and conditions on which you may use the Service and the online content/services available on it. The Service is owned and operated by SmartEconomist Limited (“SmartEconomist”).

1. Subscription Types

1.1. Individual Subscriptions
Under the terms of an Individual Subscription, access to SmartEconomist content, services or tools, and other features is for the Subscriber ONLY and may not be shared. The Subscriber has a unique combination of username and password (“ID”). SmartEconomist does not permit any other person sharing a single ID or access through a single ID being made available to multiple users on a network. SmartEconomist may cancel or suspend access to the Service if this occurs, without further obligation to the Subscriber.

1.2. Multiple-User Subscriptions
Under the terms of a Multiple-User Subscription (MUS), access to SmartEconomist content, services or tools, and other features is for each Subscriber of a MUS and may not be shared. Each Subscriber of a MUS is responsible for the confidentiality and use of the Subscriber's user name and personal password. Each Subscriber of a MUS has a unique combination of username and password (“ID”). SmartEconomist does not permit any other person sharing a single ID or access through a single ID being made available to multiple users on a network. SmartEconomist may cancel or suspend access to the Service if this occurs, without further obligation to the Subscriber.

1.3. Institutional Subscriptions
Under the terms of an Institutional Subscription (IS), access to SmartEconomist content, services or tools, and other features is defined with reference to a single location of the subscribing institution: “local access” is for an unlimited number of users (Local Users); “remote access”, if available, is restricted to local staff, faculty and students only (Remote Users). Access is based on the static IP address(es) provided by the institution. No license agreement is required. The terms and conditions of this agreement that apply to Subscribers also apply to Local Users and Remote Users of an IS, except for those related to the individual ID.

2. Copyright and Limitations
The information available through the Service is the property of SmartEconomist or its licensors, and is protected by copyright and other intellectual property laws. Information received through the Service is for the Subscriber's use only.

Subscribers may not use the Service for any unlawful purpose. Subscribers may not copy, reproduce, publish, broadcast, transmit, modify, adapt, create derivative works of, store, archive, publicly display or in any way commercially exploit any of the Service content. Without limitation, you may not do any of the following without prior written permission from SmartEconomist (and neither may you allow a third party to do any of the same):

  • with the exception of RSS feeds and personal, non-commercial use of the email newsletter service, redistribute any of the Service content; or
  • remove the copyright notice from any copies of the Service content made under these terms and conditions; or
  • create a database in electronic or structured manual form by systematically and/or regularly downloading, caching, printing and storing all or any of the Service content (by spidering or otherwise); or
  • frame, harvest or scrape the Service content or otherwise access the Service content for similar purposes.

The Service includes facts, views, opinions, and recommendations of individuals and organizations deemed of interest. SmartEconomist does not guarantee the accuracy, completeness, or timeliness of, or otherwise endorse, these views, opinions, or recommendations, give investment advice, or advocate the purchase or sale of any security or investment.

3. Disclaimer of Warranties and Liability
Due to the number of sources from which information on the Service is obtained, and the inherent hazards of electronic distribution, there may be delays, omissions, or inaccuracies in such information and the Service.

SMARTECONOMIST LIMITED AND ITS AFFILIATES, AGENTS, AND LICENSORS CANNOT AND DO NOT WARRANT THE ACCURACY, COMPLETENESS, CURRENTNESS, NONINFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OF THE NEWS AND INFORMATION AVAILABLE THROUGH THE SERVICE, OR THE SERVICE ITSELF. NEITHER SMARTECONOMIST NOR ANY OF ITS AFFILIATES, AGENTS, OR LICENSORS SHALL BE LIABLE TO THE SUBSCRIBER OR ANYONE ELSE FOR ANY LOSS OR INJURY CAUSED IN WHOLE OR IN PART BY ITS NEGLIGENCE OR CONTINGENCIES BEYOND ITS CONTROL IN PROCURING, COMPILING, INTERPRETING, REPORTING, OR DELIVERING THE SERVICE AND ANY NEWS AND INFORMATION THROUGH THE SERVICE. IN NO EVENT WILL SMARTECONOMIST, ITS AFFILIATES, AGENTS, OR LICENSORS BE LIABLE TO THE SUBSCRIBER OR ANYONE ELSE FOR ANY DECISION MADE OR ACTION TAKEN BY THE SUBSCRIBER IN RELIANCE ON SUCH INFORMATION, OR FOR ANY CONSEQUENTIAL, SPECIAL OR SIMILAR DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE SUBSCRIBER AGREES THAT THE LIABILITY OF SMARTECONOMIST, ITS AFFILIATES, AGENTS, AND LICENSORS, IF ANY, ARISING OUT OF ANY KIND OF LEGAL CLAIM (WHETHER IN CONTRACT, TORT, OR OTHERWISE), IN ANY WAY CONNECTED WITH THE SERVICE OR THE INFORMATION IN THE SERVICE, SHALL NOT EXCEED THE AMOUNT THE SUBSCRIBER PAID TO SMARTECONOMIST FOR USE OF THE SERVICE.

SmartEconomist may discontinue or change the Service, or its availability, at any time with previous notice. The Subscriber's rights and obligations under this Agreement are not assignable. If any provision of this Agreement is invalid under applicable law, the remaining provisions will continue in full force and effect.

4. Choice of Law and Jurisdiction
These terms and conditions shall be governed by, and construed in accordance with, English law.

To the extent possible in the applicable jurisdiction, the parties irrevocably agree that the courts of England shall (subject to the paragraph below) have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions, and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts.

For the exclusive benefit of SmartEconomist and to the extent possible in the applicable jurisdiction, SmartEconomist shall retain the right to bring proceedings as to the substance of the matter in the courts of the country of your residence or, where these terms and conditions are entered into in the course of your trade or profession, the country of the place of business in which you agreed to these terms and conditions or (if different) the country of your principal place of business.

5. Renewal and Refund Policies
Subscriptions are not automatically renewed. All fees and charges are nonrefundable.

6. Privacy Policy
SmartEconomist is committed to protecting your privacy. Information that we collect stays within SmartEconomist and any information distributed to third parties is reported in aggregate only. We do not give or sell your information. For more information, please read the full text of our Privacy Policy.

7. Changes to Terms and Conditions
These terms and conditions were published on September 18, 2006. SmartEconomist may revise the terms in this Agreement at any time. By using the Service after any change in the Agreement is posted, you agree to be bound by all of the changes.
